A witness for Azimio One Kenya Alliance claims that the electoral commission kept uploading and deleting forms 34A and 34B for days after its chairperson Wafula Chebukati pronounced William Ruto the winner of the presidential election.

On August 15, Chebukati announced Ruto as president-elect. One of the Azimio witnesses, Arnold Ochieng Oginga, stated in court documents he filed on Monday that the commission was using substitute applications that were posted to the web as recently as August 19, 2022.

In his opinion, the tally by the Independent Electoral and Boundaries Commission (IEBC) does not make sense. Since the total number of forms 34A stated at voting stations in at least 33 counties did not match the figure on form 34C, the man argues that 217,631 extra votes were added to Ruto’s favor.

He added that when form 34C is compared with form 34B from the constituencies, Ruto received an extra 186,693 votes. Different perspectives on the presidential election, and challenging inquiries into the voting procedure.

According to the witness, there are major inconsistencies between the forms 34A, 34B, and 34C available on the commission’s portal and the ones issued to Raila’s representatives at the polling locations.

Forms 34A and 34B have been deleted and re-uploaded to the public portal by the first respondent as recently as August 19. Oginga stated that the first respondent was replacing forms 34A and 34B with new or different forms 34A containing different results from what they had first posted and which were utilized as the basis for the result declaration.
